Additional Information

If you weave in and out of the traffic lines after having a few drinks, be prepared to weave in and out of the obstacles of the DUI legal process. Whenever one decides to get behind the wheel after having a few drinks, or consuming any kind of drugs, s/he is always rolling the dice with not only their own life, but the lives of others.

It doesn’t necessarily make you a bad person because we all make mistakes, especially this one. However, this particular mistake can become very costly and have devastating effects on your life, career, and family. So, if you ever find yourself in this unfortunate situation, it is crucial to understand your rights as well the process in it’s entirety.

South Carolina has specific laws for DUIs. Section 56-5-2930 states that it is against the law for ANY person to drive a motor vehicle in the state of South Carolina while they are under the influence of alcohol or drugs with a blood alcohol concentration level of .08% or higher.

If you are stopped under suspicion of driving under the influence and display no signs that would typically be associated with someone who is under the influence, it doesn’t mean that it stops here. If a chemical test can show a blood alcohol concentration level of .08% or greater, you can still be arrested for DUI in South Carolina.

Additionally, you could still be placed under arrest for driving under the influence in South Carolina even if the blood alcohol concentration level is below the legal limit of .08% just by displaying signs that are consistent with a person who is under the influence of alcohol or drugs.

Criminal law is comprised of a very complex body of state and federal legislation. A majority of crimes that take place are state crimes, and states will set its own definitions and punishment for state crimes.

It is likely that if you are reading this, you too at one time or another in your life broke the law or will break it in the future. Criminal charges include a wide array of offenses that range from a seat belt ticket all the way to murder. The fact is, no matter what the charge against you is, your rights are at stake. The average person typically will not have a keen understanding to criminal law or the criminal justice process. Unfortunately, ignorance of the law is almost never an adequate defense to avoid being found guilty.

If you are facing a potential jail or prison sentence, you should never be without an attorney. When you are charged with a crime, you may often feel as if you are guilty until proven innocent. You may have been taken to jail, posted bond and now must abide by the Government’s process for dealing with the criminally accused. Luckily, you are not presumed guilty, but yet presumed innocent. A strong presumption that remains with you unless the government proves your guilt beyond a reasonable doubt.

Unfortunately, it is inevitable that everyone at some time in their life will get into an automobile accident whether as a driver or a passenger. This can be a terrifying life event, and in just a few seconds your entire life can change. However, it is important to keep calm and remember these few points that can help you in dealing with your accident and as well as facilitate this whole process to make things run a bit smoother.

The first thing to remember after getting into an automobile accident is to stay at the scene. You should never leave the scene of an accident unless it is an emergency and absolutely necessary to do so (having to use the restroom really bad, although good, will likely not gain you any leniency within the court.) Also keep in mind, that if you leave the scene, particularly when there has been someone injured, you can face serious criminal consequences for being a hit and run driver.

The second thing that you should do is check yourself for injuries. Once you have checked on yourself, make sure that everyone involved in the accident is okay. Get medical attention for anyone who needs it. If a person is unconscious or has neck or back pain, don’t move them until qualified medical help arrives, unless a hazard requires moving the person.

The third thing to do is call the police. Most importantly, if there is a lot of property damage, physical injury, or death, you need to call the police who are properly trained to handle these types of scenarios. Make sure you request that a police report be filed in situations where cops do arrive to the scene. Also, make sure you obtain the name and badge number.
